New Skills and Development Levy (SDL) regulations

Skills and Development Levy: is a levy collected by TRA under the Vocational Education Training Act and Income Tax Act.

SDL is charged based on the gross pay of all payments made by the employer to the employees employed by such employer in the particular time. It is important to understand that SDL is due and payable by an employer.

The gross emoluments is a sum of amount from salaries, wages, payments in lieu of leave, fees, commissions, bonuses, gratuity, any subsistence travelling , entertainment or other allowance received by employee in respect of employment or service rendered.

New SDL regulations
A new requirement has been introduced for employers to file a monthly tax return in respect of Skills and Development Levy. Failure to file such a return may result in late filing penalties.
Part XIII of the Tax Administration Act, 2015 (“Consequential Amendments”) includes amendments to various pieces of tax legislation, including Section 16(1) of the Vocational Education and Training Act, Cap 82), which now reads as follows: “Every employer shall file with the Commissioner on or before the seventh day of each month a return setting out the total gross monthly emoluments payable by the employer to employees in respect of the preceding month and the levy payable with respect thereto”.
Employers should make note of the new filing obligation, and immediately file a return for July 2015 (if not already filed). Use

ITX 219.01.E – SDL- Monthly Return

So is the   Employer’s obligation:

  • To calculate the amount of the levy and pay the amount to Commissioners account to the respective Tax Region in which such employer is registered.

 The SDL payments shall be made using form ITX 300.01.E – Employment Taxes Payment Credit Slip.

  • To prepare a MONTHLY RETURN and submit to the TRA office on or before the 7th day of the month following the month of payroll.
  • To prepare and remit half year certificate which tally with the monthly returns submitted during the period.

Who is liable for SDL?

Any employer who employs four or more employees shall pay SDL from gross emoluments.

The rate applicable for SDL is 5% of the total emoluments paid to all employees during the month.

The employee includes permanent employees, part time employees, secondary employees, casual laborers etc.

The SDL shall not be charged to:

(a) a Government department or a public institution which is wholly financed by the Government;

(b) Diplomatic Missions;

(c) the United Nations and its organizations;

(d) international and other foreign institutions dealing with aid or technical assistance;

(e) religious institutions whose employees are solely employed to-

(i) administer places of worship; or

(ii) give religious instructions or generally to administer religion;

(f) charitable organizations; or

(g) local government authority.”.

Here is the last part of the 2014 Tanzania National Budget review. Fiscal measures The proposed fiscal changes are as follows:

•• Reduce duty rate on:
— Buses under HS Code 8702.10.99 carrying more than
25 passengers, from 25% to 10% for a period of 1 year.
— Papers under HS Codes, 4805.12.00 and
4805.30.00 only, from 25 % to 10 %.
•• Increase duty rate on:
— Chemical based (petroleum) aerosol spray under HS Code
3808.91.39 from 10% to 25%.
•• Grant duty exemption on:
— Machinery spares and inputs for use in development and
generation of wind and solar energy.
— Importation of Electronic Fiscal Devices for a period of one
year (Tanzania only).
— Importation of goods used in the manufacture of gas
•• CET rate:
— Extend the stay of application of the CET rate of 35% on
wheat grain under HS Codes 1001.90.10 and 1001.99.90,
and apply a CET rate of 10 % for the period of one year.
•• Continue to grant duty remission to:
— Soap manufacturers using LABSA raw materials under HS
Code 3402.11.00; HS Code 3402.12.00 and HS Code
3402.19.00, from 10% to 0% for a period of one year.
— The Armed Forces Canteen Organisation for another year.
•• Duty exemption
— Remove duty exemption on splints used in manufacturing
•• Taxes due on the importation of petroleum products must be
remitted on importation, rather than 45 days later.
•• The removal of cement from the list of deemed capital goods
which are tax exempted under the Tanzania Investment Centre.
•• An increase in the minimum capital requirement for foreign
investors through Tanzania Investment Center from US$ 20
million to US$ 50 million.
•• The amendment of the Business Licensing Act, No. 25 of 1972 to
enable the Government to impose new business licensing fees.
•• Reductions of the export levy on raw hides and skins from
90% or TZS 900 per kilogram to 60% or TZS 600 per kilogram,
whichever is the higher.
•• The amendment of the Vocational Education and Training Act,
CAP 82, in order to include additional institutions in the list of

Financial Sector
•• Launching of the National Financial Inclusion Framework (NFIF).
•• Tanzania Agricultural Development Bank (TADB) is established.
It’s operationalization is in progress.
•• Growth in the number of Banks from 51 in 2013 to 53 in 2014.
and insurance companies from 28 in 2013 to 30 in April 2014.
•• Capital requirement for community and commercial banks
remain unchanged – compliance is expected by 2015.

Infrastructure Development
Transport infrastructure
•• Total budget of TZS 2,109.0 billion has been set aside for
procurement of wagons, rehabilitation of the central railway line
and for the construction and rehabilitation of roads and bridges.
•• Infrastructure development is geared towards reducing
congestion in urban areas, costs of transport and transportation
of goods and services.
•• TZS 90 billion set for construction of Kinyerezi I gas fired
electricity generation plant.
•• TZS 290.2 billion is for Rural Electrification Agency (REA) for
distribution of electricity in rural areas.
Oil and Gas
•• TZS151billion set for the completion of gas pipeline from Mtwara
to Dar es Salaam.
•• Introduction of new natural gas laws.
•• Agriculture created 130,974 jobs.
•• Budget set aside a total of TZS 1,084.7 billion for strengthening
irrigation infrastructure, construction of warehouses and markets
and to create available loans for promotion of food and cash
crops production.
Human Resource Development
•• Government plans to support youth skills development in oil and
gas courses in the country and abroad. Currently 124 students
will be financed by the Government and 35 students will be
awarded scholarships by Development Partners.
•• Total of TZS 1,588.2 billion has been set aside for procurement
of medicines, prevention of epidemic diseases, and immunization
for children, construction of hospitals and dispensaries and HIV
and malaria control.
Water and sanitation
•• Total of TZS 665.1 billion has been set aside to improve urban
and rural water infrastructure which includes continuing with
the construction of 10 water wells in every Local Authority.

Taasisi za fedha Zikiongezeka kiwango cha riba kitapungua – Dk. William Mgimwa


WAZIRI wa Fedha, Dk William Mgimwa amesema kiwango cha riba kinachotozwa na taasisi za fedha zikiwamo benki nchini, zitapungua pindi taasisi hizo zitakapoongezeka.

“Sisi Serikali tunatazamia wakopeshaji hawa waongezeke ili waweze kushindana na riba ishuke”, alisema Dk Mgimwa wakati akijibu swali la nyongeza la Mbunge wa Kisesa, Luhaga Mpina (CCM) aliyehoji kwamba wastani wa riba katika benki ni asilimia 33 hali isiyomsaidia mwananchi.

Waziri huyo alisema mkopeshaji yeyote anatoza riba kwa kuangalia gharama ya kupata fedha, uwezo wa mkopaji, hatari kwa wakopaji, usalama wa mkopo na faida.

Akijibu swali la Mbunge wa Viti Maalumu, Clara Mwatuka (CCM), aliyetaka kusikia kauli ya Serikali kuhusu riba kubwa wanayotozwa wananchi kutokana na fedha zao kuweka benki, Naibu Waziri wa Fedha, Saada Mkuya Salum alisema viwango hivyo vya juu vinatokana na Sera yenyewe ya Taifa ya taasisi ndogo za fedha ambayo inasema riba itapangwa na asasi husika bila kuingiliwa na Serikali, Benki Kuu wala wafadhili.

Hiyo inatokana na asasi, zinafahamu gharama za uendeshaji, usalama wa mikopo na mbinu za biashara.

Hizo hujumuishwa kwa pamoja katika kufanya maamuzi wakati wa kupanga viwango vya riba. Alisema Serikali ipo katika hatua nzuri ya kuboresha masijala ya ardhi ili kurahisisha upatikanaji wa hati za viwanja/mashamba zitakazoweza kutumiwa na wakopaji kama dhamana na hivyo kupunguza riba inayotozwa.

“Mkakati mwingine ni pamoja na kuweka mfumo wa kusimamia taasisi zinazokopesha kwa kutumia fedha zao wenyewe. Benki Kuu inaandaa mfumo wa kuelimisha jamii juu ya mambo yanayohusu fedha na mikopo, hii itasaidia kuondoa hali ya wananchi kutozwa riba kubwa kwa kukosa tu uelewa wa masuala ya mikopo, riba na mikataba ya mikopo,” alisema Naibu Waziri huyo.

Naibu Waziri wa Nishati na Madini, George Simbachawene, amewaeleza wabunge kuwa, watanzania wanapaswa kumshukuru Mungu kwa kuwajalia gesi kwa kuwa itabadili maisha ya watu, itawezesha kupatikana mbolea, kuongeza kasi ya utekelezaji wa sera ya kilimo Kwanza, na kuiwezesha nchi kupata umeme wa kutosha.

Simbachawene ameyasema hayo bungeni mjini Dodoma wakati anajibu maswali ya nyongeza ya Mbunge wa Viti Maalum, Amina Nassoro Makilagi, ni lini gesi itawanufaisha Watanzania hasa wanawake na vijana, na Serikali ina mikakati gani kuhakikisha makundi hayo yanashiriki kuchimba nishati hiyo badala ya kuwa watazamaji tu.

Awali wakati anajibu maswali ya msingi ya Mbunge huyo, Simbachawene alisema, Serikali kupitia Wizara ya Nishati na Madini ipo katika hatua za mwisho za kuandaa sera, sheria na mpango kabambe wa matumizi ya gesi.

“Wizara inashirikiana na Mshauri Mwelekezi taasi ya Research on Poverty Alleviation (REPOA) kwa ajili ya kupitia rasimu ya Sera ya Gei asili. Mshauri mwelekezi huyo ameanza kazi tangu mwezi Mei, 2012 na anatarajia kukamilisha kazi hiyo mwezi Septemba, 2012” amesema Simbachawene.

Kwa mujibu wa Simachawene, kwa kuwa rasimu ya sheria ya gesi iliandaliwa hata kabla ya kuwepo kwa Sera ya Gesi, Wizara inakusudia kuiangalia upya rasimu hiyo ili kujiridhisha kuwa haikinzani na Sera mpya ya gesi asili.

“Hiyo inategemewa kuwa Muswada wa Sheria ya Gesi asili utakuwa tayari kuwasilishwa bungeni mwezi mmoja baada ya Sera ya Gesi Asili kukamilika”amesema.

Simbachawene amesema, watalaamu kutoka Wizara ya Nishati na Madini na Shirika la Maendeleo ya Petroli (TPDC) kwa kushirikiana na Mshauri mwelekezi kutoka Trinidad and Tobago, wapo katika hatua za mwisho za kukamilisha rasimu ya mpango kabambe wa matumizi ya gesi na kwamba, unatarajiwa kukamilika sambamba na Sera ya Gesi asili.

Waziri Mkuu, Mizengo Pinda amelieleza Bunge kuwa, kasi ya utafutaji na ugunduzi wa gesi asilia imeongezeka na kwamba, hivi karibuni kampuni zinazofanya utafiti wa gesi asilia nchini zimegundua kiasi kikubwa cha nishati hiyo chenye ujazo wa trilioni 3.

“Gesi hiyo imegundulika kwenye kina cha maji marefu baharini takriban kilomita 80 kutoka nchi kavu mashariki mwa mkoa wa Lindi. Ugunduzi huo unafanya kiasi cha gesi kilichogundulika hadi sasa kwenye kina cha maji marefu baharini  kufikia futi za ujazo trilioni 20.97” amesema Pinda wakati anawasilisha bungeni mapitio na mwelekeo wa kazi za Serikali na makadirio ya matumizi ya fedha ya Ofisi ya waziri Mkuu na Ofisi ya Bunge kwa mwaka wa fedha 2012/2013.

Pinda amesema, Serikali imejipanga kuhakikisha kwamba taifa linanufaika kikamilifu na ugunduzi wa rasilimali hiyo, na kwamba, itawawezesha vijana nchini kupata mafunzo maalum yanayohusiana na masuala ya gesi asilia ili Tanzania iwe na wataalam wazalendo waliobobea katika sekta hiyo kama ilivyoainishwa kwenye Mpango wa Maendeleo wa Taifa wa miaka mitano.

Kutoka Bungeni : Zitto on Government Budget

WAZIRI Kivuli wa Fedha Kabwe Zitto amewasilisha bungeni bajeti mbadala ya Kambi ya Upinzani kwa mwaka wa fedha 2012/2013.
Zitto amebainisha kasoro nyingi zilizopo katika bajeti ya Serikali iliyowasilishwa bungeni Alhamisi iliyopita.
Bajeti ya Zitto ilitanguliwa na hotuba ya Msemaji  Mkuu wa Kambi ya Upinzani kuhusu Ofisi ya Rais – Mipango, Christina  Mughwai ambaye pia alibainisha alichokiita udhaifu wa Serikali  katika kuitekeleza mipango yake ya kiuchumi.
Zitto ambaye pia ni Naibu Kiongozi wa Upinzani Bungeni katika hotuba yake  alisema mapato ya Serikali yanaweza kuongezwa kwa Sh2.885 trilioni,  hivyo kupunguza utegemezi wa mikopo ya kibiashara ambayo imekuwa  ikiligharimu taifa kiasi kikubwa cha fedha. Vyanzo vya kodi na  kiasi cha fedha kwenye mabano alivyopendekeza ni marekebisho ya kodi za  misitu ukiwemo mkaa (Sh130.8 bilioni), kupunguza misamaha ya kodi,  kuzuia ukwepaji kodi na udanganyifu wa biashara ya nje (Sh742.74  bilioni), mauzo ya hisa za Serikali (Sh415.55 bilioni), Marekebisho ya  kodi Sekta ya Madini na asilimia 25 ya Mauzo ya Madini Nje (Sh578.36  bilioni) na Marekebisho ya Kodi na Usimamizi bora wa Mapato Kampuni za  Simu (Sh502.26 bilioni).

Mapendekezo mengine ni Marekebisho ya  Kodi ya Tozo ya Kuendeleza Stadi (Sh243.52 bilioni), mapato ya  wanyamapori (Sh61.64 bilioni), kuondoa msamaha wa ushuru wa mafuta kwa  kampuni za madini (Sh44.9 bilioni), Usimamizi wa mapato ya utalii  (Sh51.75 bilioni), Kuimarisha biashara Afrika Mashariki (Sh 114.15  bilioni).

Zitto alisema kama wapinzani wangekuwa madarakani  wangekusanya kiasi cha Sh15 bilioni sawa na ile ya Serikali, lakini  tofauti ni hatua ya kutenga asilimia 35 ya mapato ya ndani kwa ajili ya  utekelezaji wa miradi ya maendeleo na kupunguza utegemezi wa bajeti  kutoka asilimia 42.37 za Serikali hadi asilimia 21.3.


Amesema, Serikali haipaswi kuendelea kukopa, kwani taarifa rasmi za kibenki na  ukaguzi wa hesabu zinaonyesha kwamba deni hilo linakua kwa kasi tofauti  na maelezo ya Serikali kwamba linahimilika.

“Taarifa ya Mdhibiti na Mkaguzi Mkuu wa Hesabu za Serikali inaonyesha kuwa Deni la Taifa  linazidi kuongezeka kwa asilimia 38 kutoka Sh10.5 trilioni mwaka  2009/2010 hadi Sh14.4 trilioni 2010/2011. Kwa mujibu wa Waziri wa Fedha, Deni la Taifa limefikia Sh20.3 trilioni mpaka ilipofika mwezi Machi  mwaka 2012,”

alisema Zitto na kuongeza:       “Ukisoma taarifa ya Mwezi wa Mei 2012 ya Benki Kuu ya Tanzania, Deni la Taifa sasa limefikia Sh22 trillion. Suala hapa sio ustahmilivu wa Deni kama inavyodai Serikali,  bali ni kwamba tunakopa kufanyia nini?”

Alisema hesabu za bajeti ya Serikali ya 2012/13 inayopendekezwa zinaonyesha kwamba Serikali bado ina mpango wa kukopa kwa ajili ya kugharamia matumizi ya kawaida ambayo hayazalishi wala kutozwa kodi. “Hatutaki mikopo kwa ajili ya  matumizi ya kawaida ya posho, kusafiri, magari n.k. Tuchukue mikopo  kuwekeza kwenye miradi itakayokuza uchumi na kuzalisha kodi zaidi,”  alisema.

Kuhusu mfumuko wa bei, Zitto alikosoa hatua  zinazopendekezwa na Serikali kukabiliana nao, kwamba ni zile  zilizoshindwa katika mwaka wa fedha unaoishia Juni 30, mwaka huu. Alisema hatua hizo ambazo ni kutoa vibali kwa wafanyabiashara vya kuagiza  mchele na sukari bila kutoza kodi, haziwezi kusaidia kwa kuwa hatua kama hizo zilipochukuliwa awali zilisababisha bei ya bidhaa hizo kuongezeka. “Baada ya hatua hii bei ya sukari ilipanda kutoka Sh1,700 mpaka 2,800 kwenye  maeneo mengi nchini… Serikali inachukua hatua zile zile kwa tatizo lile  lile ikitegemea matokeo tofauti,” alisema Zitto.

Alirejea  pendekezo la mwaka jana kwa Serikali kutoa vivutio kwa wakulima wadogo  kuzalisha chakula kwa wingi akisema kuwa hatua hiyo pekee ndiyo  itapunguza mfumuko wa bei. “Hakuna mbadala wa kudhibiti mfumuko  wa bei zaidi ya kuongeza uzalishaji wa chakula na kuwekeza kwa wananchi  wetu.

Serikali inafikiria uzalishaji utaongezeka kwa kusaidia wakulima  wakubwa ambao watageuza wananchi wetu kuwa manamba na vibarua ndani ya  nchi yao,” alisema na kuongeza: “Tuwekeze kwa watu wetu vijijini ili waongeze uzalishaji na kwa kufanya hivyo mfumuko wa bei ya chakula  utakuwa historia. Hakuna mwarobaini wa kupanda kwa bei za vyakula  isipokuwa kilimo”.

Kutoka Bungeni: Misamaha ya Kodi Kupunguzwa

WIZARA ya Fedha imesema, Serikali ina lengo la kupunguza misamaha ya kodi ili isizidi asilimia moja ya pato la taifa.

Naibu Waziri wa Fedha, Saada Mkuya Salum ameliambia Bunge mjini Dodoma kuwa, Serikali inaendelea kupitia baadhi ya sheria za misamaha ya kodi ili kuangalia kama bado zina manufaa kwa umma.


Amesema, ili kutimiza azma hiyo, Mamlaka ya Mapato (TRA) kupitia mfuko wa dhamana wa ushauri wa sera na usimamizi wa kodi ulioanzishwa na Shirika la Fedha la Kimataifa (IMF) inafanya uchambuzi wa kina wa kuangalia sheria na kanuni za misamaha ya kodi.


Kwa mujibu wa kiongozi huyo wa Serikali, uchambuzi huo utaleta mapendekezo ya kuiondoa misamaha yote isiyo na maslahi na tija kwa taifa.


Salum amesema, mwaka ujao wa fedha, Serikali imechukua hatua za kurekebisha sheria mbalimbali za kodi kwa nia ya kupunguza misamaha na kuzuia mianya ya ukwepaji kodi.


Alikuwa akijibu swali la Mbunge wa Viti Maalumu Amina Abdulla Amour (CUF) aliyetaka kufahamu ni lini Serikali itapunguza misamaha yakodi hadi kufikia chini ya asilimia moja ya pato la taifa kutokana na kuwa kero kwa muda mrefu kwa taifa kukosa fedha na mapato kwa ajili ya maendeleo.


“Sisi pale wizarani tumeamua kulivalia njuga suala hili, tutaifanya kazi hiyo na tunaomba tupewe muda kwani jambo hili haliwezi kufanyika kwa mara moja,” alisema.


Wakati huo huo, Salum alisema Benki ya Wanawake inaweza kushiriki katika mpango wa kukopesha na kusimamia fedha za mabilioni ya Rais endapo inahitaji kufanya hivyo na taasisi zingine za fedha ambazo zimekidhi vigezo vilivyowekwa.


Alitaja vigezo hivyo kuwa ni pamoja na uwezo wa kuhudumia vijijini, kuwa na mizani nzuri za hesabu na uzoefu katika kuhudumia wajasiriamali wadogo.


Alisisitiza kuwa walengwa wa mfuko wa mabilioni ya Rais ni vijana, wazee, wanawake vijijini na mijini ambao wanafanya shughuli katika kuhudumia wajasiriamali wadogo.


Alikuwa akijibu swali la Mbunge wa Viti Maalumu Faida Mohamed Bakar (CUF) ambaye alihoji kama Serikali inakubaliana naye kwamba sasa ni wakati muafaka wa kuhamisha fedha za mkopo wa mabilioni ya Kikwete na kutumika katika Benki ya Wanawake ili wananchi wapate mikopo.


Wakati huohuo, Kamati ya Kudumu ya Bunge ya Fedha na Uchumi, imeafiki maeneo mengi ya kodi na tozo mbalimbali yaliyopendekezwa na Serikali kufanyiwa marekebisho, lakini ikasisitiza umuhimu wa nidhamu ya matumizi ya Serikali na uwezo wa kuongeza mapato.


Mbali na hayo, Kamati hiyo ilieleza kutoridhishwa na Serikali katika kasi ya kushughulikia misamaha ya kodi.


“Kamati inaishauri Serikali kuonesha dhamira ya kweli kufanikisha lengo hilo (la kuimarisha taratibu za kukusanya mapato pamoja na kupunguza misamaha ya kodi) na kutoa taarifa ya utekelezaji mbele ya Kamati Januari 2013,” amesema Mwenyekiti wa Kamati hiyo, Andrew Chenge.


Chenge alikuwa anawasilisha taarifa ya Kamati yake kuhusu hali ya uchumi wa Taifa kwa mwaka 2011 na Mpango wa Maendeleo wa Taifa kwa mwaka 2012/13 pamoja na tathimini ya utekelezaji wa Bajeti ya Serikali kwa mwaka 2011/12 na mapendekezo ya mapato na matumizi ya Serikali kwa 2012/13.


“Kamati inaendelea kushauri kwamba Serikali iachane na mtindo wa kuibua matumizi mapya yasiyo ya dharura ambayo hayakuidhinishwa na Bunge wakati wa utekelezaji wa bajeti”


“Mtindo huo unavuruga bajeti na kupunguza uwezo wa kutoa fedha za matumizi mengineyo (OC) na matumizi ya maendeleo kama ilivyokusudiwa. Kamati inasisitiza umuhimu wa Serikali kubana matumizi kwa kupunguza matumizi yasiyo ya lazima,” amesema Chenge.

During their review, the publication’s editor Don Winkler and publisher Mike Potashnik visited the winelands in December 2011 to evaluate the country’s top premium and ultra-premium wines, and at the same time evaluated its wine tourism.

“While the country is located far from most foreign wine lovers, it offers huge rewards to those who visit its wine country,” they wrote in their latest report.

“Most wineries have excellent tasting facilities and many have superb restaurants with spectacular mountain vineyard views.”

Andre Morgenthal, spokesperson for the Cape Town and Cape Winelands chapter of the Great Wine Capitals (GWC), is excited over the revelation.

“That is high praise indeed, coming as it does on the back of the US Weather Channel recently placing the Cape winelands second after Andalucia in Spain on its annual list of the World’s Top Ten Wine Trails,” he said.

The attractions of the wine industry are seen as a major factor in the growth of Cape Town’s tourism industry.

“Wine tourism is a vital product offering as it helps improve the country’s competitiveness against destinations like Brazil, Australia, Kenya and Thailand,” said tourism minister Marthinus van Schalkwyk.

It is estimated that wine tourism now generates annual income in excess of R5-billion (US$590-million) while also being a major job creator. The total wine exports from South Africa stood at 350,564,774 litres in 2011, with Europe as its biggest buyer overall.

Van Schalkwyk said the wine tourism sector in South Africa will always have strong roots from which to grow even further in the international market.

“I believe wine tourism can contribute in a significant way and we look forward to continued constructive engagement with the industry,” he said.

Tanzania Government has put forward strategies to boost Tanzania’s locally produced Wine ‘Dodoma Wine’. The 2012/2013 budget attracts lower duties compared to imported. If this opportunity used wisely we can start our own wine tourism vilage in Dodoma.
